San Diego Plans Appeal of Beach Ruling

This is why I love politics and beaurocracy. Silly and stupid things like the argument that some judge and others are making about the bacteria levels in the Children’s Pool and who is responsible for them. We all know that the seals are ultimately “responsible” for the bacteria levels being as high as they are. But, is the City of San Diego able to do anything about the seals? This is just dumb. I liked La Jolla better when it wasn’t at the top of everyone’s “Top 10″ lists:

San Diego is appealing a judge’s order requiring excavation of the beach at Children’s Pool in La Jolla in hopes of solving a bacterial problem caused by harbor seals. City Attorney Mike Aguirre’s office announced the appeal yesterday. The City Council had approved the appeal during a closed session on Feb. 21. The council passed the measure 7 to 1, with Council President Scott Peters casting the dissenting vote, according to a statement from the City Attorney’s Office. In August, state Judge William C. Pate ruled that the city, by allowing the seals to take refuge at the cove and pollute the water, had violated the terms of a 1931 trust that transferred ownership of the cove from the state to the city. The trust requires the Children’s Pool to be used exclusively for recreational purposes and as a public park and bathing pool for children. The judge ordered San Diego to restore the water quality within six months by dredging or excavating sand at the cove, an action that could force the seals to abandon the site.
